General Terms and Conditions and customer information
Last updated: 15 October 2026
1. Seller and scope
These terms apply to purchases of goods through the Smartrock online shop between smartrock GmbH, Landsberger Str. 234, 80687 Munich, Germany, and our customers. Contact: info@smartrock.de, telephone +49 89 21637028. Further company details are provided in our Legal Notice.
A consumer is a person acting predominantly for purposes outside their trade, business or profession. A business customer acts in the course of a trade, business or profession when entering into the contract. Individually agreed terms take precedence over these terms.
2. Ordering and formation of the contract
Product listings invite you to place an order and do not themselves constitute a binding contractual offer. You can add products to the cart, review quantities and selections, and proceed to checkout. There you enter billing and, where applicable, delivery details, choose an offered payment method and review the order summary, including the total price and shipping costs.
By clicking “Jetzt kaufen” or “Buy Now”, you submit a binding offer to purchase. We promptly acknowledge receipt by email. The contract is formed when, within three working days, we accept your offer through an express order acceptance in text form, a request for payment, or delivery of the goods. If the automatic confirmation email already contains express acceptance, the contract is formed when you receive that email. For a payment method involving an immediate collection, we accept the offer no later than when we initiate collection of the payment. If we do not accept within that period, you are no longer bound by your offer.
The product information available before you order determines the characteristics and items included. Any deviation from those characteristics or from statutory requirements is agreed with consumers expressly and separately, subject to the applicable statutory conditions.
3. Corrections, contract language and documents
Before submitting your order, you can correct entries using the usual browser and form controls, change the cart or abandon checkout. Contracts may be concluded in German or English; the language selected during checkout applies. Both versions of these terms set out the same provisions.
You can print or save the order summary and these terms using your browser before submitting the order. We retain order details to perform the contract. You receive the order information and the contractual terms applicable when the contract is formed, including the cancellation policy, by email on a durable medium. If you use a customer account, you can view your order overview there; we do not promise permanent account access to every historical contractual document.
4. Prices, payment and additional costs
The prices in euros displayed before submission apply. They include VAT applicable to the relevant delivery where VAT is charged. Any shipping costs are shown separately. The complete amount payable is displayed at checkout before you place your order.
The payment methods displayed in the relevant checkout are available. For advance bank transfer, pay the amount after the contract is formed in accordance with the payment request; goods are dispatched after payment is received. For other methods, payment is collected in accordance with the conditions shown during checkout. Payment processing provided by a payment service does not change your statutory rights against us.
Deliveries outside the European Union may incur additional import duties, import VAT and processing fees in the destination country. Unless we expressly undertake to pay them or collect them during checkout, the recipient pays them to the relevant authorities or service providers. Checkout takes account of the tax treatment applicable to the delivery.
5. Delivery countries, shipping and delivery times
Direct online orders are currently available for delivery to: Austria, Belgium, Bulgaria, Canada, Croatia, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, the United Kingdom and the United States of America. For other countries, contact us before ordering; delivery requires a separate agreement.
Shipping services, costs and information about international transit times appear under Shipping and delivery and during checkout. The delivery time specified for the product and destination applies; for advance payment, it starts after payment is received. Delivery times may differ for international destinations and between shipping services.
For consumers, we bear the risk of accidental loss or damage in transit until the goods are handed to the consumer or a person designated by them who is not the carrier. The statutory exception for a carrier independently commissioned by the consumer without having been proposed by us remains unaffected.
6. Retention of title
The goods remain our property until the purchase price has been paid in full.
7. Withdrawal
Consumers have the right of withdrawal described in our Cancellation Policy, with a period of 30 days. That policy explains when the period starts, returns, return costs and reimbursement. You can also declare withdrawal using the “Withdraw from Contract” function linked throughout the website. Other permitted methods, particularly email, remain available.
8. Statutory rights concerning defects and commercial guarantees
Statutory rights concerning defective goods apply. For new goods, the usual limitation period for claims concerning defects is two years from delivery; statutory exceptions, extensions and any longer mandatory periods remain unaffected. Subject to the statutory conditions, remedies include free repair or replacement and, where applicable, a price reduction, termination of the contract or damages.
Any additional commercial guarantee applies only in accordance with the terms expressly provided by the relevant guarantor. It does not limit your statutory rights concerning defective goods. Information about manufacturer guarantees actually offered is provided with the relevant product.
9. Liability
We are liable without limitation for intent or gross negligence and for harm to life, body or health. Mandatory statutory liability, particularly under the German Product Liability Act, liability for fraudulently concealed defects and liability under a guarantee we have assumed also remain unaffected.
For a slightly negligent breach of an essential contractual obligation, liability for property damage and financial loss is limited to damage typical of the contract and foreseeable when it was formed. Essential obligations are those whose performance makes proper fulfilment of the contract possible and on whose performance you may normally rely. Liability for other property damage and financial loss caused by slight negligence is excluded. The mandatory exceptions stated above also apply here.
10. Transport damage and complaints
Please report visible transport damage to the carrier and to us where possible. For consumers, this request is not a condition for retaining withdrawal rights or rights concerning defective goods. Send complaints and order enquiries to the contact details in section 1.
11. Applicable law and jurisdiction
German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. Consumers retain the protection of mandatory provisions of the law of their country of habitual residence that would apply in the absence of this choice of law.
Only if the customer is a merchant, a legal entity under public law or a special fund under public law is our registered office the agreed place of jurisdiction, to the extent legally permitted. Statutory rules of jurisdiction apply to consumers; no exclusive jurisdiction in Munich is agreed for consumers.
12. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
